Right To Information (RTI)

As per Section 6 of the Notification dated 10th May 2013 issued by Government of Arunachal Pradesh clearly mentions that “The University shall be self-financed. It shall neither make a demand nor shall be entitled for any maintenance, grant-in-aid or any other financial assistance from the State Government or any other body or corporation owned and controlled by the State Government”.

In the case of Tyndale Biscoe School & Ors v. Union Territory of J & K & Ors. reported in 2022 SCC OnLine J&K 300 that a private educational Institution which may require recognition or is recognized by the appropriate Government under any law for the time being in force does not ipso facto become a public authority within the meaning of term given in Section 2(h) of the Act of 2005 unless it is either owned, controlled or substantially financed by the appropriate Government.

Apex Professional University is an autonomous self-financed private University and does not receive any grant-in-aid from any Government and hence, Apex Professional University does not fall within the purview of the Right to Information Act, 2005.

Apex Professional University does not fall under the preview of Section 2(h) of the Right to Information Act, 2005, even then the information which is of public interest, is regularly being updated on the University website.
